California AG Jerry Brown’s job description is to “represent the people of California in civil and criminal matters before trial courts, appellate courts and the supreme courts of California and the United States.” Kind of hard to do that when he and his staff break the law themselves now isn’t it?
California Penal Code Section 632 prohibits the recording of private telephone conversations without consent, and the state is one of 12 that require notification of all parties prior to taping.
Scott Gerber, spokesman for Brown’s office, admitted to not only taping a phone conversation with SF Chronical Reporter Carla Marinucci, but acknowledged doing it routinely.
Adding to this, the call apparently focused on a corporation that both had sensitive business before Brown’s office and had made a major campaign contribution to him! Attorney General Brown needs to not only fire this staffer, but “represent the people of California” in prosecuting this crime.
